1. Introduction

This website is owned and operated by Monique McNamara, trading as With Love Monique. These Terms and Conditions set out the rules under which you may use our website and the products and services we offer at https://www.withlovemonique.com, including our styled stock photo collections, Canva templates, mini courses, and the Heart-Worthy Content Club membership. By accessing or using this website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use this website.

2. Who Can Use This Site

You must be at least 18 years old, or the age of legal majority in the country where you live, to make a purchase, create an account, or join a membership on this site. By using this site you confirm that you meet this requirement. Use of this site is prohibited in any jurisdiction where it would be unlawful. Some parts of the site, including the membership content, courses, freebie library, and groups, require you to create a free account before you can access them.

3. Key Commercial Terms

When you place an order on this site, your purchase becomes a binding transaction once payment has been accepted and you receive confirmation. All prices are displayed in US Dollars (USD) unless stated otherwise. We may change the prices of any product, membership, or course at any time, but price changes will not affect purchases you have already completed. Payment is taken at the time of purchase through our secure checkout. Where a subscription is purchased, payment is taken at the start of each billing period. You are responsible for any taxes, bank charges, or currency conversion fees that your bank or payment provider may apply to your purchase.

Membership subscriptions renew automatically. The Founding Member plan is billed monthly at the price displayed at sign-up and renews each month until you cancel. You can cancel at any time from your member account or by emailing hello@withlovemonique.com. When you cancel, you keep access until the end of the billing period you have already paid for, and you will not be billed again. We do not provide refunds or credits for partial billing periods. The Heart-Worthy Content option is a one-time payment and does not renew. Before any subscription begins, the price, the billing interval, and how to cancel are shown at the point of sign-up.

4. Returns and Refunds

All products sold on this site are digital products that are delivered immediately by download or by direct access after purchase. Because you receive immediate access to the complete product, all sales are final and we do not offer refunds or exchanges once a product has been accessed or downloaded. This applies to stock photo collections, Canva templates, mini courses, and one-time membership purchases.

If you experience a technical problem with a product, for example a broken download link or a file that will not open, contact us at hello@withlovemonique.com and we will put it right.

If you are a consumer in the European Union or the United Kingdom, you normally have a 14 day right to withdraw from an online purchase. By purchasing a digital product on this site you expressly request immediate delivery of the digital content and you acknowledge that you lose your 14 day right of withdrawal once delivery has begun. Nothing in these Terms removes any right that the law of your country gives you and that cannot be excluded by agreement, including your rights under the South African Consumer Protection Act where it applies.

5. Right to Change the Offering

We may change, pause, retire, or discontinue any product, course, membership benefit, group, or other part of the offering at any time and without prior notice. We may also restrict access to some or all of the site temporarily or permanently, for example for maintenance or security reasons. Where a change materially reduces what an active paid membership includes, we will let members know in advance where reasonably possible.

6. Digital Product Licence

When you purchase a styled stock photo, photo collection, Canva template, or any other digital product from this site, you are buying a licence to use it, not ownership of it. Each purchase grants you a personal and single-business commercial use licence. Under this licence you may use the products across your own business, including on your website, blog, social media, print media, email marketing, advertising, and within digital products such as courses, workbooks, and ebooks, provided that the primary value of your final product is your own content and the images cannot be extracted from it.

Under this licence you may not resell, re-licence, sub-licence, redistribute, transfer, loan, lease, share, or give the files, in any form, to any third party. You may not sell or give away the images or templates as standalone files, individually or in bundles, and you may not create derivative products for sale where the primary value of the end product is the image or design itself, including templates, themes, wallpapers, prints, mugs, stickers, clipart, or similar items. You may not use the products for client work unless your client has purchased the products themselves. You may not use any part of the images in a logo. You may not use the products for anything illegal, offensive, pornographic, or defamatory, and you may not claim that you or anyone else created the original images or templates. If you would like to use a product in a way this licence does not cover, contact us at hello@withlovemonique.com to ask about an extended licence.

Some products are delivered as templates for the Canva design platform, and some may include elements from Canva's own libraries. Access to certain elements may depend on the Canva plan you hold, and Canva may change its plans, element availability, or terms at any time. We are not responsible for any additional costs or loss of access that results from changes made by Canva or any other third-party design platform. Please verify that you can access the elements you need before relying on a template.

7. Course Access Terms

Mini courses and programs purchased or accessed on this site are self-paced. Access begins when your purchase or enrolment is confirmed and continues for as long as the course remains part of our offering and your relevant purchase or membership remains active. We may update, improve, or replace course content from time to time. Courses are provided for your own education and business use and the same licence restrictions in Section 6 apply to any downloadable course materials. Completion certificates are not issued.

8. Membership Terms

The Heart-Worthy Content Club is offered through the membership plans displayed on our plans page. The benefits of each plan are described at the point of sign-up and may include course content, caption and content templates, engagement and story templates, discounts on shop products, and monthly bonus content. Billing and cancellation terms for each plan are set out in Section 3.

If your subscription lapses or is cancelled, your access to member content ends when your paid period ends. Benefits that were available to you while your membership was active, such as discount codes, end at the same time. Anything you downloaded under your licence while your membership was active remains licensed for your continued use under the terms of Section 6.

Membership usage rules

Member resources are provided for use in your own business only. You may not resell, edit for resale, or commercialise any member resource. Member resources may not be redistributed at scale and may not be the primary feature or main selling point of any course, membership, or subscription that you operate; they are for supplementary use within your own content. You may not share original editable links, including Canva template links, with any third party. You may share finalised, flattened versions of content you have created with the templates, such as exported images or PDFs, in the normal course of marketing your own business.

The membership is intended for individual business owners. We reserve the right to refuse or revoke access where use does not align with the intended purpose of the membership. We welcome constructive feedback, and we reserve the right to use member comments, reviews, and messages as marketing material, handling identifying details with care. Members are expected to behave professionally in all member spaces; defamatory or disparaging conduct toward the business or other members is a breach of these Terms.

9. Freebie Library and Free Membership Tier

We offer a free membership tier and free resources, including the free caption template library, which require you to create a free account to access. By creating an account and accessing any free content, you agree to these Terms in full.

Free does not mean unrestricted. All of the usage rules that apply to paid member resources in Sections 6 and 8 apply equally to free resources: no resale, no commercialisation, no redistribution, no sharing of original editable links, and no use of free resources as the primary feature of another product, course, or membership.

Creating a free account means we collect personal information from you, such as your name and email address. This information is handled as described in our Privacy Policy at https://www.withlovemonique.com/privacy-policy, which you should read before signing up. We may update, remove, or change free resources at any time without notice, and we may suspend or revoke free access for any breach of these Terms.

10. Affiliate Program

We operate an affiliate program through which approved affiliates can earn a commission on qualifying membership sales they refer. The current structure offers a 15 percent recurring commission on referred membership sales for as long as the referred membership remains active, with payouts made quarterly via PayPal once an affiliate's balance reaches the minimum payout threshold of 50 US Dollars. Referred customers are permanently attributed to the affiliate who first referred them.

The affiliate program is managed through a third-party platform, GoAffPro, and joining the program requires creating an account on that platform, which is governed by its own terms and privacy policy. We reserve the right to change the commission structure, payout schedule, or any other aspect of the program, to disqualify referrals that are fraudulent, self-referred, or otherwise abusive, and to suspend or close the program or any affiliate account for breach of these Terms. Changes to the program do not affect commissions already properly earned.

11. Accounts, Suspension, and Termination

You are responsible for keeping your account login details secure and for all activity that happens under your account. We may suspend or terminate any account that breaches these Terms, infringes the rights of others, or is used unlawfully. Where an account is terminated for breach, any active paid subscription tied to that account is not refunded for the remaining period. You may request deletion of your account at any time by emailing hello@withlovemonique.com; deletion of personal data is handled as described in our Privacy Policy.

12. User Conduct

Where the site allows you to post or submit content, including blog comments and posts in member groups, you must not post anything unlawful, harmful, defamatory, abusive, or misleading. You must not infringe anyone else's intellectual property, attempt to hack, scrape, or disrupt the website, use the site to send spam or unsolicited commercial messages, or impersonate any person or business. We may remove any user content and suspend any account at our discretion.

Please be aware that content you post in member groups is visible to other members of those groups, and your member profile may be visible to other members. You can leave a group, or ask us to remove your contributions, at any time.

13. Intellectual Property

All content on this website, including text, images, photographs, graphics, logos, templates, video, audio, course materials, and software, is owned by or licensed to Monique McNamara, trading as With Love Monique. Except for the licence expressly granted to you when you purchase a product or join a membership, no rights or licences are granted to you. You may not reproduce, modify, distribute, or commercially exploit any content from this site without our prior written permission.

If you submit or post content on this site, including comments and group posts, you confirm that you own it or have the right to post it, and you grant us a non-exclusive licence to display it on the site. We may remove user content at our discretion.

Copyright complaints: If you believe material posted by a user on this site, for example a blog comment or group post, infringes your copyright, please contact us at hello@withlovemonique.com with: identification of the copyrighted work; identification of the material you believe infringes it and where it appears on the site; your contact details; and a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law. On receipt of a valid complaint we will review and, where appropriate, remove or disable access to the material. If your own content was removed and you believe this was done in error, you may contact us at the same address.

14. Third-Party Links and Services

This website contains links to third-party websites and uses third-party tools and services, including the Canva design platform on which many of our templates are built, the GoAffPro platform that manages our affiliate program, the payment providers that process checkout payments, our social media profiles on Instagram, Facebook, Pinterest, and X (Twitter), and the private Facebook group connected to our club. We are not responsible for the content, practices, or policies of any third-party website or service, and you access them at your own risk. Where a third-party service processes your personal information, that processing is described in our Privacy Policy and governed by the third party's own privacy terms.

15. Privacy and Data

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 16. Promotional Communications

Opting out of marketing does not affect transactional messages such as purchase confirmations and account notices.

17. Indemnification

You agree to indemnify and hold harmless Monique McNamara, trading as With Love Monique, from any claims, losses, liabilities, and expenses, including reasonable legal fees, that arise from your use of this website, your breach of these Terms, or your violation of any law or the rights of any third party.

18. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of this website or any product or service purchased through it, including loss of profits, data, goodwill, or business interruption. 21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. If a dispute arises from these Terms or your use of this website, both parties agree to first attempt to resolve it through good-faith negotiation for a period of thirty days. If the dispute remains unresolved, the parties will consider mediation before either party approaches the courts of the Republic of South Africa, which will have jurisdiction. If you are a consumer located in another country, you may also have the right to bring proceedings in your own local courts, and you keep the protection of any mandatory consumer protection laws of the country where you live. Nothing in these Terms overrides those rights.
