3. What Personal Data We Collect

Data you provide directly:

• When you use our contact form: your name, email address, and the contents of your message.
• When you join our mailing list or download a free resource: your name and email address.
• When you create a member account or join the club (including the free tier): your name, email address, and password, plus any profile details you choose to add.
• When you make a purchase: your name, email address, and billing address. Your payment card details are collected and processed by our payment provider, not by us, and we never see or store your full card details.
• When you join or participate in a course or program: your enrolment details and your progress through the content.
• When you post a blog comment or a post in a member group: the content you post, your display name, and your profile photo if you have one. Comments and group posts also log your IP address at submission.
• When you join our affiliate program: your name, email address, and PayPal email address, collected through the GoAffPro platform.

Data collected automatically:

When you browse this site, Wix Analytics collects technical and usage information such as your IP address, browser type, device type, pages visited, session duration, and referring site. This is standard analytics data used to understand how the site is used. We do not run any third-party analytics or advertising trackers on this site.

Data from third parties:

We receive order and subscription information from our payment provider when you complete a purchase, and referral performance data from GoAffPro if you are an affiliate. We do not buy or import personal data from any other source.

• Account details (name, email, password) - to create and manage your member account and give you access to member content. Lawful basis: contract.
• Purchase and billing data - to fulfil your order, deliver your products, and process payment. Lawful basis: contract.
• Purchase records - to meet tax and accounting record-keeping obligations. Lawful basis: legal obligation.
• Course enrolment and progress data - to provide the course and remember where you are in it. Lawful basis: contract.
• Blog comments and group posts (including IP address) - to display your contribution, keep member spaces safe, and prevent abuse. Lawful basis: legitimate interest.

6. How We Store and Protect Your Data

All payment transactions on this site are processed through PCI-DSS compliant payment gateways. 7. How Long We Keep Your Data (Retention)

We keep personal information only for as long as it is needed for the purpose it was collected for, or as long as the law requires. The periods below apply, based on South African legal requirements as our primary framework.

• Contact form enquiries: kept for 3 years from the date of last contact, in line with the standard prescription period for civil claims under the South African Prescription Act 68 of 1969.
• Mailing list data: kept until you unsubscribe, then deleted within 30 days.
• Member account data: kept for as long as your account is active. If your account is inactive for 24 months, or you delete it, your data is deleted or anonymised within 90 days, in line with the POPIA storage limitation principle.
• Membership subscription records: kept for the duration of your active subscription plus 3 years after cancellation, in line with the prescription period for contractual disputes.
• Purchase and financial records: kept for a minimum of 5 years, as required by the South African Income Tax Act 58 of 1962 and Tax Administration Act 28 of 2011.
• Blog comments and group posts: kept for the life of the associated content plus 12 months after removal; IP address data from submissions is deleted after 12 months.
• Affiliate records: kept for the duration of your participation in the program plus 5 years for commission and tax records.
• Analytics data: retained for up to 14 months, in line with the Wix Analytics default retention setting.

8. Who We Share Your Data With

We share personal information only with the following categories of recipients, and only to the extent needed:

• Wix.com Ltd., our website platform and hosting provider, which processes data on our behalf as described in Section 2.

10. Your Rights

You have rights over your personal information. The rights that apply to you depend on where you live.

All users. Wherever you are, you can ask us what data we hold about you, ask us to correct inaccurate data, ask us to delete your data, and withdraw consent where our processing is based on consent.

South Africa (POPIA). As our primary framework, POPIA gives you the right to access the personal information we hold about you, the right to request correction or deletion of it, the right to object to processing, and the right to lodge a complaint with the Information Regulator of South Africa at inforegulator.org.za or complaints.IR@justice.gov.za.

European Union and United Kingdom (GDPR). If you are in the EU or UK, you have the right to access your data, the right to rectification, the right to erasure, the right to restriction of processing, the right to data portability, the right to object to processing, and the right to withdraw consent at any time. You also have the right to lodge a complaint with a supervisory authority: in the UK, the Information Commissioner's Office at ico.org.uk; in the EU, the data protection authority in your member state. We respond to requests within 30 days.

California (CCPA/CPRA). If you are a California resident, you have the right to know what personal information is collected, used, shared, or sold, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising these rights. We do not sell or share your personal information as those terms are defined in the CCPA. We respond to verified requests within 45 days. Please note that the CCPA's obligations formally apply to businesses above certain size thresholds, which this business does not currently meet; we honour these rights as best practice regardless.

Brazil (LGPD). If you are in Brazil, you have the rights set out in Article 18 of the LGPD, including confirmation that we process your data, access to it, correction of incomplete or out-of-date data, anonymisation or deletion of unnecessary data, portability, deletion of data processed with consent, information about who we share data with, information about the consequences of refusing consent, and revocation of consent at any time. The supervisory authority is the Autoridade Nacional de Protecao de Dados (ANPD) at anpd.gov.br. We respond to access requests within 15 days.

11. How to Exercise Your Rights

To exercise any of these rights, email hello@withlovemonique.com with the subject line "Data rights request" and tell us what you would like us to do. We may need to verify your identity before acting on a request, which we will do using information we already hold, such as matching your name and email address or an order reference. We respond within the timeframes listed in Section 10, and within 30 days for South African requests. Some data cannot be deleted on request because the law requires us to keep it, for example purchase records kept for tax purposes; where that applies, we will explain what we have kept and why.

12. Marketing Communications

We send marketing emails, including new resources, monthly club content, coupon codes, and sale announcements, only to people who have opted in by joining the mailing list, downloading a free resource, or joining the club. Every marketing email includes an unsubscribe link, and you can also unsubscribe by emailing hello@withlovemonique.com. Unsubscribing from marketing does not affect transactional emails such as purchase confirmations, download links, and account notices, which we still need to send you.

13. Children's Privacy

This website is not directed at children under the age of 18 and we do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a child, please contact us at hello@withlovemonique.com and we will delete it promptly.

14. International Data Transfers

We serve customers worldwide, and your data may be stored or processed in countries other than your country of residence. Our site is hosted on Wix's global infrastructure, which means data may be stored on servers in the United States, the European Economic Area, and other locations as part of Wix's normal platform operations. Wix.com Ltd. participates in the EU-US Data Privacy Framework, and its Data Processing Agreement, available at wix.com/about/privacy, covers international transfer obligations at the platform level.

Where your data is transferred across borders, we ensure appropriate safeguards are in place in accordance with applicable data protection law. For transfers of South African data, POPIA section 72 permits cross-border transfers where the recipient is subject to protections substantially similar to POPIA or where you consent. For EU and UK data, transfers rely on adequacy decisions, Standard Contractual Clauses, or the EU-US Data Privacy Framework and UK-US Data Bridge as applicable. For Brazilian data, transfers are made under LGPD Article 33 mechanisms. Third-party services we use, including GoAffPro and PayPal, may process data in their own locations under their own compliant transfer mechanisms.
